Partner attorney Ohoon Kwon analyzed, “NFTs based on real assets such as real estate or artworks are highly likely to be judged as securities. However, since NFTs based on a concept such as a simple digital guarantee are less likely to be deemed as securities, the business model may be allowed to proceed if the relevant regulatory requirements are met.”
