During the discussion, Oh Hoon Kwon, Managing Partner of Chae & Kwon Law Offices, explained that a clearer legal analysis is needed regarding the nature of stablecoins. He pointed out that discussions have not yet sufficiently matured on how the relationship between virtual assets and stablecoins should be defined, and added that if Korean won-denominated stablecoins are granted a right of redemption, their relationship with debt securities under the Financial Investment Services and Capital Markets Act should be carefully reviewed. He also emphasized that their relationship with electronic money and prepaid electronic payment means under the Electronic Financial Transactions Act, as well as potential conflicts with the Foreign Exchange Transactions Act, should be key issues in future regulatory design.
