Hong Kong Uses Blockchain for Legal Notice... Calls for New Measures

In cryptocurrency-related cases, identifying perpetrators is often difficult, and tracking funds becomes nearly impossible when using offshore exchanges or decentralized exchanges (DEXs). To address this issue, Hong Kong recently implemented blockchain-based service of process. The court registered legal documents as NFTs on the TRON blockchain and airdropped them to the defendant’s cryptocurrency wallet. Additionally, Soulbound Tokens (SBTs) were used to ensure that anyone accessing the wallet could see its involvement in criminal activity. This has sparked discussions in Korea about adopting similar methods. Attorney Ohoon Kwon emphasized the need for legal reforms to formally recognize blockchain-based service and expand international legal cooperation to enhance its effectiveness. However, he also pointed out that ensuring enforceability is crucial—issues such as whether the recipient actually views the notice or the possibility of asset transfers must be addressed through legal and technical safeguards.
