Meta Kongz, a Korean NFT project, is preparing an NFT fractional investment business. Partner attorney Ohoon Kwon analyzed, “NFTs based on real assets such as real estate or artworks are highly likely to be judged as securities. However, since NFTs based on a concept such as a simple digital guarantee are less likely to be deemed as securities, the business model may be allowed to proceed if the relevant regulatory requirements are met.”
