Reduced Probation on Appeal in 'Fraud Related to Cryptocurrency Recruitment' Case

In a case where a client was sentenced to imprisonment for illegal recruitment of virtual assets, Cha & Kwon Law Offices obtained a stay of execution through a reasonable response.
Recently, there has been a trend of harsher sentences for so-called “Ponzi schemes,” including not only virtual assets but also multi-level finance, and it is therefore necessary to provide an appropriate and thorough legal response in criminal proceedings.
In this case, we handled a single case involving fraud at the recruitment stage of a virtual asset recruitment program. The defendant was sentenced to imprisonment in the first trial for incidents that occurred during the recruitment process for two investment products (virtual asset recruitment and financial pyramid scheme) and was detained in court until the appeal. Through the settlement and restitution process and sufficient presentation of legal and factual issues, the defendant was able to obtain bail and return home, and subsequently obtained probation in the appellate judgment, enabling him to continue earning a living without losing his job.
